A) A Member can terminate the membership during the Membership Usage period by tendering a request in writing duly signed by both the applicant and the co-applicant. In the event the communication for withdrawal of the application by the Applicant is received beyond forty-eight hours from the date of OEH realization the Down Payment made by him it shall be treated as are request for cancellation (as opposed to withdrawal of application detailed under clause 10.1
above and rules for cancellation shall apply. As observed in Clause 13 above, the AF amounting to 60% of the Membership price is non-refundable and only 40% of the EF is payable subject to deductions as stated in Clause 10.2 herein below.
B) In the event of termination OEH by the Member, the Member shall be entitled to refund of the EF paid after deducting the amounts set out Clause 10.2 below.
C) Termination by ONE EARTH HOSPITALITY

 ONE EARTH HOSPITALITY reserves the right to terminate the package/vacation ownership plan/membership on the occurrence of any of the following events.

A Vacationer user shall be liable to pay all taxes/charges/levies statutory or otherwise imposed by or payable to any government or local body or any other authority on Vacationer price/ AMC any other charges arising out of purchase /use of “ONE EARTH HOSPITALITY” gateway (taxes). Non-payment of taxes and levies shall disentitle the Vacationer user from enjoying vacations and shall amount to breach of contract and result in termination of Vacationer agreement.
I. Default in payment of Membership price by the Member.
II. Default in payment of AMC in full or in part for two consecutive years by the Member.
III. Breach of house Rules of Resorts located both inside and outside India by the Member.
IV. Breach of contract by the Member.
V. Any other action by the Member and/or his/her/its guests or occurrence of any event or situation within the premises of OEH Affiliated Properties located both inside and outside India constitute a criminal offense against the
Member or those accompanying the member. The refund shall be by and subject to clause 10.2 of this Agreement. 

D) Deduction upon Cancellation/Termination Upon withdrawal of application as mentioned in clause 10.2 above the following deductions shall be made by OEH from the amounts paid by the Member towards the EF.

(a) pro-rated EF for the period (in years) from the start of membership usage period to the date of termination of the membership of the year shall be treated as a full year for the purpose of calculating the deductions.
(b) Outstanding AMC together with interest if any
(c) Taxes due
(d) Cost of holidays enjoyed by the member in excess of entitlement.
(e) Any other amounts/due to OEH the member shall not be entitled any refund of the EF, It was OEH shall refund the balance amount if any, after deductions, set out in clause 10.2 above and after adding the amounts that may be due on the member post 90 days from the date of receipt of the cancellation request.
